Federal news: Supreme Court blocks federal vaccine mandate for large employers; OSHA pulls down emergency rule
OSHA Update:
Following a January 13, 2022 U.S. Supreme Court blocking OSHA’s vaccine emergency temporary standard (ETS) from taking effect for employers with 100 or more employees, OSHA formally withdrew the ETS on January 25th.
The Supreme Court decision and OSHA’s withdrawal means that large employers no longer have to follow the January 10, 2022 requirement to vaccinate or weekly test employees for COVID-19.
Next steps for large employers:
- Continue to develop policies for employees who test positive, and ensure your COVID quarantine and isolation protocols are consistent with current CDC guidance. THLA can assist if you have questions.
- If your company is one of the few hospitality businesses with an existing vaccine requirement and/or testing regime for employees, today’s decision does not affect your policy.
